The Settlement

A settlement has been reached regarding allegations that Gap Outlet, Gap Factory Store or Banana Republic Factory Store used false or misleading reference prices. Gap has denied any wrong doing but has agreed to settle the case.

Who’s Eligible

If you made an in store or online purchase from Gap Outlet, Gap Factory Store or Banana Republic Factory Store between May 24, 2010 and May 10, 2019 and did not receive a refund or credit from your purchase you may be eligible to receive one or more $6 Settlement Purchase Certificate(s).

What Will You Receive?

This will depend on the purchases you made during the eligible period (May 24, 2010 and May 10, 2019):

  • less than $90.00 (Tier 1), good for $6 for any purchase or off any purchase (no minimum purchase required)
  • $90.00 or more (Tier 2), good for a total value of $12 for any purchase or off any purchase (no minimum purchase required) and I have attached proof of my purchase(s).

Important Dates

  • January 6, 2020 – Deadline to submit a Claim Form.
  • September 23, 2019 – Deadline to submit an Objection.
  • September 23, 2019 – Deadline to submit a request for Exclusion.
  • October 11, 2019 – Date of Fairness Hearing.

Our Verdict

If you’re eligible for this settlement I’d recommend filing a claim unless you actually plan to peruse individual action (highly unlikely). I suspect a lot of people will be eligible. Claims for $6 do not require proof of purchase if you’ve lost yours (remember lying on these forms is highly illegal), claims for $12 do require proof of purchase.

    "This certificate is a single-use certificate good for $6.00 toward any purchase of merchandise in any Gap Outlet, Gap Factory Store and Banana Republic Factory Store or any of their respective websites in the United States. Settlement Purchase Certificates will be valid for one (1) year from the date of issuance."

  • Out of curiosity, What's the oldest order folks here see listed in their account online?

    Old Navy is the place I buy my clothes most frequently, as they have a good assortment of tall sizes and good prices.

    My wife empties her Email inbox pretty frequently. So I am limited to what I have listed in the account online. - They only show limited history and show 2 small orders from 2018. I'm certain I've made hundreds of dollars in purchases in the eligible time period. (I used to spend much more than I do now.)

    I sent Old Navy an Email asking for older history, but low hopes of them taking the extra initiative to get this for me.

    Everyone in my Family has bought something there in that time period, so we can at least get a number of $6 coupons, but a $12 coupon would be much more likely to cover something useful.

  • Will credit card statements work for the proof of >$90 of purchases? Don't have receipts any more. I'm sure we spent over $90 though.

  • what do you mean by? "did not receive a refund or credit from your purchase" I purchased clothing online using a promo code, but did not return anything

    • I think if you spent more than $90 from May 24, 2010 to May 10, 2019, you qualify for the $12 coupon if you can provide proof of purchase. I just screen captured my e-mail receipts and attached them to my claim.

      • To be fair $6 store credit is probably better than "up to $6 cash" which ends up being a check for a few cents.

    • Is this a new business scheme? Fake a class action, give out coupons for merchandise that induce more spending.....
      Next we’ll see bed bath and beyond settling one of these by giving out 20% off coupons as the payout.
