Recap: Woman Refused Access To Bathroom, Fake AirBnB Scam & More

  • I Worked at Capital One for Five Years. This Is How We Justified Piling Debt on Poor Customers. The New Republic. I actually don’t think Capital One sounds that bad in this piece, especially as it seems to have been written as a ‘hit piece’. It’s also interesting that this person talks about a secured card being a lending option, when really it’s used to rebuild credit. I think she fundamentally misunderstands what a secured credit card is for, for example she compares it to a payday loan but nobody is going to hand over a security deposit for a secured card in those circumstances as they want access to more money not the same amount (or less after an annual fee). I have a lot of issues with secured cards and companies that specifically target people rebuilding credit and Capital One is far from perfect but they are actually one of the better issuers in this space.

Sexism? I couldn’t imagine them doing the same to a 250 lb guy. or really to anyone who just simply ignored them and went ahead and went into the bathroom anyways.***

For some things it’s far better not to ask permission.

*** $1000 says this would never what happened to the lady that was on my Southwest flight the other day. A grandmother and her young granddaughter are in a row about 8 rows from the back and mentioned to a lady in the isle that they had someone else coming. In the rudest way possible, the lady said there was no saving seats and her and her husband were going to both sit in the aisle seats in that row. (While she was technically right, I’m dumbfounded that someone would speak this way to someone you have to sit with for the next two and a half hours. The mother coming aboard ended up sitting across the aisle with the lady’s husband, being unable to sit with her mother and daughter. This wasn’t a big deal until her mother got sick and thought she was going to throw up or pass out . – meaning: 1. No one was really watching her daughter at that point. 2. The lady that made such a fuss nearly got thrown up on.

While extremely assertive and abrasive people can get on your nerves, perhaps sometimes it’s good to “channel them” in certain situations.

I for one appreciate the reporting here at DOC as it pertains to catching airlines and other modes of transport mistreating their clientele, so they may be held accountable for their actions and encouraged to change their ways.

DOT requires airlines to give passengers access to lavatories during Tarmac delays – as well as food and beverages, and I believe CTA has requirements which mirror those of the U.S.

If this story is true, I bet the airline is gonna get whacked with a huge fine.

This incident happened in Bogata, Colombia. Would the Canadian Transportation Agency (CTA) have jurisdiction? Genuine question. I have no idea. Do Canadian regulations govern this Air Canada flight at a Colombia airport? Or would Colombian-only regulations apply? Or some combination of Canadian authority and Colombian authority? Does anybody know?

I would have to imagine some Canadian rules apply to this Canadian company no matter where the plane happens to be in the world at the time. But maybe Colombia has its own rules that say that every passenger has to be seated on the tarmac no matter what.

No idea.

Man you are flying air canada you should expect this kinda shit to happen. They are like the worst airline in North America. When I had delays with United before they usually give me snacks and drinks and after the flight took off they turn the WiFi on for free. Best delay I had was with cathay pacific they talked to pilot and just served the food before we even took off

The FAs don’t have any indication of when the plane is going to start moving. They aren’t warned before it moves. I can understand the frustration from the passenger’s standpoint and the FA should have made a better attempt to communicate with the cockpit and ask for some guidance on allowing this bathroom break…

But if she had been allowed to go to the bathroom and the plane started moving, possibly into it’s takeoff roll (we don’t know what stage of the flight they were in from the article) there could have been injuries. Those injuries, although likely very minor, may have resulted in lawsuits and termination for the employees involved.

And that’s not even to mention FAA regulations that may be at play here. It was definitely wrong to deny her, but it’s not quite as simple to do so as most would believe.

In my experience, they usually do let the pilots know that someone is up and about when the restroom is required prior to takeoff, especially during a delay. But yeah, usually it’s only a big deal when the plane is taxing to take-off, not sidelined and delayed.

This I-was-prevented-from-using-the-bathroom story sounds made up. No flight goes 7 hours without use of the lavatory. My suspicion is she simply pissed her pants and wants to blame the airline. I would charge her to clean the seat and ban her from the airline.

I’m thinking it was more that she had an accident during the delay and was too embassassed to get up, especially if she had nothing to change into in a carry on.

October 3, 2019 10:32

Wow. Did you not read the article?

The incident occurred before the plane took off, during a 2-hour tarmac delay when the passengers were forced to stay on the plane. The FA named John refused access to a bathroom for this passenger for some reason. A presumably different FA did allow a different passenger access to a bathroom during the same period of time. AC has already admitted that they were at fault.

Michael
Michael (@guest_818158)
October 3, 2019 16:21

There was no admission of anything from Air Canada in the article.

Jay
Jay (@guest_818278)
October 3, 2019 20:28

“…the airline, who admitted staff should have allowed her use the bathroom.”

If you don’t see this as an admission that the FA did something that he shouldn’t have, then I don’t know what to say to you.

“The company added that the issue had been reviewed by their in-flight management team and had been brought up with the cabin crew involved.”

I sure hope that team has addressed the issue decisively. Clearly most of the other FAs on the plane did the right thing, but John let the rest of his crew down. It’s hard to blame AC for the actions of one individual unless it can be proven to be a chronic issue of under-training. However, AC’s response and compensation have underwhelmed, and a $500CAD flight voucher is laughable considering that most people wouldn’t take that for even something much less harmless like a voluntary bump. Hell, that’s worth even less than what Canada’s passenger protection law will require airlines to pay for 3-hour delays in their control ($400CAD cash).

I absolutely have been denied access to the bathroom during flights. As someone with bladder issues (for which I have consulted doctors), I have come very close to wetting myself during flights.

This is the perfect time to start recording interaction’s with flight crew in a calm manner – even to the point of then using the FA button – if they shut if off, or lock it out – take it viral- reachout to the Airline via Twitter in real time. Remain calm and professional – even if the need is urgent.

I’m not sure what the laws are in Ireland, Canada, Colombia (or whatever jurisdiction would govern this flight) but in the United States you are (generally) correct. They can’t deny you access to the bathroom. Well… instead of “can’t”, I should say “won’t. They won’t deny you access to the bathroom.

Technically they can deny you access to the bathroom by telling you directly to sit down. You have to follow their instructions. You’ll get in legal trouble if you don’t follow their instructions.

But they’ll almost never directly tell you that you absolutely can’t use the bathroom. What they’ll do is remind you is that the captain has put the seat belt sign on. And they’ll leave it for you to take a hint and sit back down without them having to directly tell you to. But you can still use the bathroom even with the seat belt sign on… unless they directly tell you to sit back down. And if they directly tell you to sit back down, it’s usually for a very good safety-related reason.

Key & Peele had a very relevant skit a few years ago:

There’s also the question of how a reasonable toilet-needing person would interpret someone’s statements that may or may not be commands.
“Miss, I think you should sit down.”
“Miss, there’s turbulence here, it’s best for you to be in your seat.”
“Miss, it’s not really time to use the toilet.”
Etc etc etc.

Are these literally just statements expressions of an opinion or a suggestion? Or are these outright prohibitions that are politely worded? Are you going to engage the flight attendant in a way that forces them to clarify this and potentially look like a hostile asshole like Key&Peele? Or are you just going to avoid confrontation?

If I really truly had to piss, sure, I would. But I’d imagine a lot of people wouldn’t.

Matt
Matt (@guest_818270)
October 3, 2019 20:14

Indeed, and that’s is precisely the point. They won’t tell you “No!” (most of the time). They’ll instead offer strong-suggestions until you sit down on your own accord.

But if you have to go, you have to go. And flight attendants don’t want to have to clean up your urine (or worse!). They’ll make strong-suggestions, but if you reasonably (and politely) explain that this is a “must go now!” situation (and not simply an “it would be nice to go now, but I can actually wait” situation) they’ll drop the matter.

(Obviously, there are some examples of truly unreasonable flight crews. But most of the time you can calmly explain the situation and have it resolved to your liking. Again, nobody on the flight wants to have to clean up your excreta.)

I guess you can consider their strong-suggestions as a sort of test. A test to weed out the “must go now!” people from the “I can actually wait” people.

Whatever you do though, don’t get angry. Be assertive, but polite and respectful.

Honestly I can’t think of a better time to employee your phone and video – if at first you you have a problem, in a calm voice – “so if I understand you correctly your denying me the use of the bathroom? Is this correct.”. If the FA retaliate or get Captain involved

. I’m not saying to be like the ranting Alaska Passenger upset about wanting to use the F cabin bathroom – IIRC (I could be wrong – all passengers are allowed to use any passenger bathroom on a plane in US airspace or on a US carrier – again – I’m not positive.

But if you remain calm – and your denied the use of the bathroom – even moreso if a plan is late or delayed.

Yeah, that’s Crap about a $500 AC voucher.

Your site is looking more like VFTW. Taking longer to go through the blogs to find relevant material. Used to be easy and the main reason I came here. Wish you’ld go back to your old formula and target relevancy to making money with credit.
Just my 2 cents if you value all feedback.

He’s just posting what he thinks is interesting and worth pursuing. I would rather support DOC than those dumb ass bloggers like VFTW who thinks they are “public figures” for simply repeating information and knowledge stolen from other FTers. Not to mention that fat f* frequently posts biased reviews based on how much referrals and freebies they get from credit card companies and airlines.

Speaking of dumb ass bloggers, did you know that OMAAT allegedly was banned from United because he hacked United e-certs (back in the day when UA used to give them out like candy)? When was the last time your saw his posts about United?

Do yourself a favor and just continue to read DOC. Do not give hits to any of the bloggers on BA or click on their credit card referrals. If you want credit card bonus, either come here or just google it and apply directly with the bank.

I agree. Too many articles for making $2. Most deals take more effort than are worth. Even most of the news articles in this are old news. At least 3 days old.

Anyway boardingarea has become pretty much worthless. Only credit cards and news about flying with nothing that would set it uniquely apart. Most of the time the commenters know more than the bloggers.

Doc is still relevant but don’t dilute the brand and turn it into slickdeals, couponcenter etc.
Anyway i don’t know what i am saying but doc website has felt off lately and seems others think the same.
