Citibank Class Settlement
Citi was sued by Plaintiff Ramona Edery who says that they called Citibank at 800-745-1534 and the call with personal information was recorded, despite there not having been any such disclosure or expectation. (Ramona Edery v. Citibank, N.A., Case No. CGC 14-538436)
Citibank denies Plaintiff ’s allegations and denies that it violated any laws. A settlement has been reached with Citi agreeing to pay up to 1.5M to affected consumers.
Who is Eligible?
If, from April 3, 2013 through May 15, 2013, you participated in one or more telephone conversations with Citibank by dialing 800-745-1534, and Citibank recorded/monitored your call without disclosing the recording/monitoring to you.
On the claim form, you need to input the phone number from which you called.
Update: Apparently, the settlement is for California residents only.
How Much Can We Get?
Between $350 and $2,500, depending on how many people join the class settlement.
Important Dates
- June 28, 2016 is the final date for joining the class settlement
- The Final Approval Hearing is scheduled for August 26, 2016
Final Thoughts
$350 – $2,500 is substantial and some people may have called 800-745-1534 in April-May of 2013. The big problem here is:
- knowing that you called this particular Citi number
- knowing which phone you called from
- knowing if they disclosed the monitoring or not during the call
I was going to put in a claim under my home number (I figured they’ll check their records and see if there was a call made or not), but then I saw that they require you to certify under penalty of perjury that you made the call.
For practical purposes, most of us won’t be able to file a claim, but you can try checking your phone logs and see if you did make such a call. Note that you don’t have to certify that they didn’t disclose the recording – only that you called 800-745-1534 during those dates.
