Trader Joe’s Class Action Settlement: FACTA Violation [3/5/19 – 7/19/19]

It’s alleged that Trader Joe’s violated Fair and Accurate Credit Transactions Act, 15 U.S.C. § 1681c(g)(1) et seq. (“FACTA”) by printing the first six digits and last four digits (but no middle digits or other information) of credit cards and debit cards on receipts from purchases made between March 5, 2019 and July 19, 2019. Trader Joe’s insurer has agreed to pay $7,400,00 to resolve the matter.

Who’s Eligible? 

Anybody that made a purchase at Trader Joe’s between 3/5/19 – 7/19/19 using a debit or credit card is eligible. Receipt from purchase must have included ‘ first six and last four digits of the card number used’

It looks like you need a Claim ID and PIN, otherwise you need to download a personalized claim form and send it in. 

How Much?

Total settlement pool is $7,400,000 and class counsel expects to petition the court for $2,466,666.67 plus attorney fees. How much you receive will depend on how many people apply for the settlement. 

Our Verdict

This is a strange one, think this type of violation is better served with a government mandated fine considering no information was actually used for data theft. That being said anything that punishes corporations for not properly securing data is a good thing. Don’t think it’s worth filing a claim if you don’t have the claim ID and PIN as it needs to be done manually.
