The Settlement

Several airlines have been accused of price fixing flights between U.S. and Asia, Australia, New Zealand, or the Pacific Islands from 2000 to 2016. They have all denied any wrongdoing, but have agreed to a settlement (All Nippon Airways is yet to agree to a settlement). They have agreed to pay $49 million into the settlement fund plus $750,000 to help pay for the costs involved. The estimated average payment per claim is $8.50 based on the claims previously received.
Who Is Eligible
You are eligible for a settlement if you purchase a ticket for air travel from one of 26 airlines between January 1st 200 and December 1st 2016 and the ticket included at least one flight segment originating in the U.S. to Asia or Oceania. The airlines are as follows:
- Settling Defendants:
- Air New Zealand Limited;
- China Airlines, Ltd. (Taiwan);
- EVA Airways Corporation; and
- Philippine Airlines, Inc.
- The alleged Defendants and Co-Conspirators are:
- American Airlines, Inc.;
- Asiana Airlines, Inc.;
- British Airways, Plc.;
- Continental Airlines, Inc.;
- Delta Airlines, Inc.;
- Deutsche Lufthansa AG;
- International Air Transport Association;
- Korean Airlines, Ltd.;
- KLM Royal Dutch Airlines;
- Northwest Airlines Corporation;
- Scandinavian Airlines System;
- Swiss International AG;
- United Airlines, Inc.; and
- Virgin Atlantic Airways, Ltd.
- The following airlines previously agreed to settlements and the Court has given !nal approval to these settlements:
- Cathay Paci!c Airways Limited;
- Japan Airlines International Company, Ltd.;
- Malaysian Airline System Berhad;
- Qantas Airways Limited;
- Singapore Airlines Limited;
- Societe Air France;
- Thai Airways International Public Co., Ltd.; and
- Vietnam Airlines Company Limited.
- The Non-Settling Defendant is:

How To File A Claim
If you’re eligible you should have received a postcard in the mail with a claimant ID number, you can enter that here to proceed with your claim. If you didn’t receive that, you can still file a claim with your address, e-mail and other details here.
Our Verdict
I don’t see anything in the fine print that excludes award flights, so I suspect a lot of readers will be eligible (correction, these are excluded in the FAQ). Some will think it’s not worth the effort for $8.5 but I think it’s always worth participating in these class actions as you never know how much you’ll receive and as a consumer it’s one of the small things you can do to show that this sort of thing isn’t tolerated.

I received the first check a couple of months ago and immediately noticed a problem. The check was marked as invalid after 30 days and when I received the check it was already day 31. Being on active duty and stationed overseas causes significant mail delays.
I sent an e-mail to the settlement administrator and they basically told me too bad. So I did a little research and found the contact data for the attorneys who are dealing with this case and e-mailed them. They replied! They promised that when the second distribution was made they would also reissue the first one and send them both via PayPal.
They told me the second distribution would be in January 2025, but that was delayed. Then they said March. That never happened. Then they said June. Nope. Finally they said around July 1st and that went well.
I got two payments. One for about $500 and the second for a bit over $40. Not that the $540 lasted long. Wife used it to buy a “cheap” pair of shoes and dress.
Is there any way you would mind emailing me the email you used to finally get help with it?

The way it was explained to me is that it was the court itself that disallowed issuance of checks after the cutoff date. When the court ordered issuance of the second round of checks, they were able to also pay the first round check that I was never able to cash.

The actual settlement administrator, Rust Consulting, is a stinking pile of shit. I was going to write a scathing letter t the actual judge on this case to complain.

I received the “second” check this week.. but never received the first one.. does that mean the first one is lost? I’ve tried emailing the contact info on the settlement web site 3x now.. and nobody has ever replied. Any other way to reach someone handling it?

Is there anyone who can help me?? I received a check, but I live outside of US territory and they agreed to give me in Paypal which had failed and they agreed to give me in bank transfer which I haven’t got it yet. Now, the website is not available and my settlement money has been help for over 1 year. Please somebody help me.
Finally got my check today, a whopping $14.41. I actually did fly a few transpacific flights, and some domestic on those airlines (listed like 20 flights) but hey, anything > nothing.
$200 for me. Took maybe 6 flights? All on EVA or China Airlines. Thought this was an impressive payout but congrats to the folks getting thousands!
How do I cash this cheque in Australia ??? No banks will take it. Is anyone else having issues. It is for 79.89 not a large amount
