Capital One Agrees To $190 Million Settlement Over Data Breach

(See updated post here)

In 2019 Capital One suffered a data breach affecting 100 million individuals in the United States. At the time Capital One stated that the information that was stolen was not disseminated but Wired later found that the stolen information was posted on a public github and that at least one person accessed that information. In August 2020 The Office of Comptroller of the Currency (OCC) assessed an $80 million civil money penalty against Capital One.

According to The Seattle Times Capital One has now agreed to a $190 million settlement over a class action lawsuit that was filed. Currently the court is evaluating the settlement that will cover 98 million Americans.

190 million settlement cover 98 million American, so each should receive $2? Isn’t it? How could it be hundreds of dollars for each person?

got this email a few days ago:

We are reaching out with regard to your upcoming payment in the Capital One Data Breach Settlement. It has been determined that a portion of your pro rata award, which is part of your Settlement Payment under the terms of the Settlement Agreement and Consumer Settlement Benefits Plan, is taxable income for federal, state, and local tax purposes and must be reported to the appropriate taxing authorities.

At this time, we are requesting you complete a Form W-9 to avoid withholding taxes at the current rate of 24 percent. Please submit your Form W-9 information online at http://www.CapitalOneSettlement.com/W9Request and log in using the Unique Identification Number provided above. Please respond by October 5, 2023.

If you respond with a valid tax ID, the Settlement Administrator will issue a Form 1099 in January of 2024 with your Social Security number, or other tax identification number. If you do not respond, the Claims Administrator will issue you a Form 1099 in January of 2024, which will only contain your name and address, and the pro rata award will have 24% withheld and remitted to the Internal Revenue Service.

Another lawsuit? I already have several claims with several companies pending and just recently got over $600 in a lawsuit from a natural gas distributor that I was a previous customer. The amount that you can get can vary widely.
