A class action settlement has been reached in a lawsuit that alleges Kohl’s used false advertising to make a sale seem more than it was. They referred to a price as ‘30% off the regular price’ or ‘30% off the original price’ when that higher number wasn’t the true regular/original price.

Kohl’s denies any wrongdoing. So as to avoid costly litigation, parties have agreed to reach a Class Settlement.

Who is eligible?

The Settlement Class includes anyone who shopped at Kohl’s in the State of California who purchased from Kohl’s one or more items at a discount of at least 30% off of the stated “original” or “regular” price, and who have not received a refund or credit for their purchase. But only for purchases made between June 11, 2011, and April 11, 2016.

How to file a claim?

Many people got a Claim ID and PIN code via email which can be used to file a claim online here. If you don’t have an ID and PIN, you can still file a claim online here. You can also choose to mail in the form, here’s the PDF.

No receipts are needed to file a claim, and it just takes a minute to go through the process.

How much can we get?

The amount of the payment is unknown and will depend entirely on how many people partake in the class lawsuit. There is over $6M distributed in total, although $2-3M is going for the cost of administration and attorneys.

Payment will be made in the form of a Kohl’s gift card. You can choose an electronic gift card or physical one.

Important Dates

  • Claim Form must be submitted by August 9, 2016
  • The Final Approval Hearing is scheduled to occur on September 12, 2016; if there are appeals to the final approval order, they can take time to resolve

Final Thoughts

I imagine there are lots of California resellers or shoppers who bought 30% discounted items from Kohl’s over the past five years. We don’t know how much money you’ll end up with (probably not much), but it’s easy enough to file a claim, and it’s probably worth doing if you know you’re eligible.

I am beginning to think this is FAKE. At first I believed it because I also got one fro JC Penney. All Class Action claims have always been sent in the mail. Then the email they used to send me this information is in NO WAY associated with Kohls at all. It is not linked to my Kohls Charge Card or Rewards. So that led me to search the internet. There are articles out there saying a judge denied a suit on April 4th. I am thinking it is FAKE.
