Our Verdict

It seems like the discount varies based on ride length with shorter rides getting the 5% discount and longer rides getting the 30% discount. The California exclusion is likely due to a court stating that Uber and other ride sharing programs must treat drivers as employees.

If I was Uber or Lyft I would pull out of the California market. Drivers meet none of the traditional requirements of employees, as opposed to independent contractors.

(1) Drivers decide when to turn on the app and if they will accept a fare. “Employers” direct “employee’s” workload and shifts.

(2) Drivers often display Uber and Lyft decals on their cars. This is like a cook filling an order at McDonalds and then running across the street to fill an order at Burger King. What “employer” allows its “employee” to work for the competition at the same time???

If drivers do not like the compensation they receive from Uber or Lyft, there are other options for work. If the State of California cannot collect self-employment taxes from the drivers, that is the state’s revenue enforcement problem not Uber’s or Lyft’s.

Is it legal to work two shifts at McDonalds and Burger King at the same time? Yes. Can you get fired for it? Absolutely. (Also, CA is at-will employment) Is it a breach of ethics? Probably.

It may be different in your state, but in California, they must meet all of the following criteria to be an independent contractor:

(A) that the worker is free from the control and direction of the hirer in connection with the performance of the work, both under the contract for the performance of such work and in fact; (B) that the worker performs work that is outside the usual course of the hiring entity’s business; and (C) that the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed for the hiring entity.

Up until a month or two ago, Uber dictated ride pricing and payouts. They have changed this in CA in an attempt to make them be more independent-contractor-ish. We shall see whether this works.

I really doubt Burger King or Mcdonalds give a rats ass about whether you flip Big Macs by day and Whoppers by nightfall…Breach of ethics?? LOL. The only breach of ethics is the minimum wage they pay… It would be different if we are talking about high-level executives double dipping at both companies.

Likewise…Uber/Lfyt…come on. It’s not like trade secrets are being shared. Anybody can download both apps. They don’t care and if double dipping means you only work enough hours with the one to be classified as “part-time” employee, even better for them as you are entitled to less benefits.

Frankly that discount will probably at best price match Lyft. I have yet to see a trip request that cost more on Lyft than on Uber.
