[Checks Received] Class Lawsuit: Get $6 Per Box Of Kotex Tampons Purchased (Up To $30)

Update 12/26/20: Reader Jennifer reports: “Received check today. I claimed full $30…and received the funds today. Only received $16.15 though. Just want to point out, the check is actually a small postcard, and i almost threw it away, thinking it was junk. So be on the lookout.”

A $7 million class action settlement has been announced amidst allegations that U by Kotex tampons unravel and come apart. The following products are included:

  • U by Kotex® Sleek® Tampons
  • U by Kotex® Fitness® Tampons
  • U by Kotex® Click® Tampons
  • U by Kotex® Security® Tampons in Regular, Super, or Super-Plus Absorbency

Defendant denies any wrongdoing or unlawful conduct and asserts that the products at issue were safe to use and were manufactured consistent with the law.  The Court has not decided who is right.  Both sides have agreed to settle the dispute and give benefits to Class Members.

Who is Eligible?

If you bought one of the above-mentioned U by Kotex®-brand tampons between March 8, 2013 and November 19, 2019, you could receive a cash payment from a class action settlement.

How Much Can We Get?

The Settlement will provide up to $7,000,000 to pay claims for those who purchased one or more boxes of U by Kotex® tampon products.

  • Get up to $6 per box purchased, and up to $30 total, without Proof of Purchase.
  • Get full retail cost above $30 with Proof of Purchase.

You may be entitled to a $6.00 cash payment for each box of Subject Product you purchased during the Class Period, up to a maximum of $30.00 in cash if you do not have Proof of Purchase. Class Members who claim more than $30.00 in benefits must submit Proof of Purchase establishing purchase(s) during the Class Period for each box of Subject Product claimed in excess of $30.00 and may receive benefits based on the retail value of the Subject Products shown in the Proofs of Purchase.

If the total value of all approved claims is greater than the amount of money available to pay claims, eligible Class Members’ payments will be reduced proportionally. Thus, the amount of your payment will depend on the total amount of money you spent on the Subject Products during the Class Period, whether you have Proof of Purchase for the products you bought, and on the number of Class Members who choose to make a claim.

Important Dates

  • 3/8/13 through 11/19/19 – dates when your purchase makes you eligible
  • 7/20/20 – court date hearing
  • 8/18/2020 – final day to submit a claim

Our Verdict

Kotex is one of the popular tampon brands (according to Google; sorry, guy talking here), so I imagine many people will be eligible. Hopefully an easy $30 (or more with receipts); lots of men can be eligible too if you ever bought these for your partner. Of course, do not file if you didn’t actually buy these.

Got my check today and I tried to deposit in Fidelity, Bank of America, Citi and Heritage Bank apps. None of them like to because it’s postcard size even when doing manual capture. The endorsement line being in the wrong direction probably also doesn’t help. Has anyone found an app that likes it? I will probably have to go to a bank branch to deposit it.

I wonder who keeps the money from the checks that are never cashed because people gave up after the first app rejected it?

My guess is that the entire reason we got a second round of checks with a relatively high amount is that many people from the first round gave up on trying to deposit it and let the checks expire, so there was more residual money than expected.
For the record, I tried with SoFi, Ally, Capital One 360, One Finance, and PNC. All gave errors. It took me many tries but I finally got it to work with SoFi. P2 got it to work with Ally.

Someone below said it worked with Ally. I don’t have an account with them. I have a checking account with Citi that I opened for a bonus. Maybe I’ll see if their ATM accepts it. If not, I can always use a (shudder) teller.

Reminds me of the days years ago when we used to get postcard checks all the time for rebates from Staples, CompUSA and others. I recall that Citi’s ATMs did not like them back then.

Same here. I had already received a check for $16.15 on January 13, 2021. It’s now August 24, 2021, and I received an additional check for $7.64. It notes that it’s a second payment as a result of residual funds.

I just got my $16.15 check yesterday. Deposited via Ally mobile app and it worked fine despite the weird endorsement signature location.
