How can we sue Capital One in small claims? I’d rather go that route than wait for a few pesos thru class action settlements. How do we prove harm?
Start by hiring a lawyer? Or just ask a random internet chat board?
I would say wait for the Class action settlement award, then opt out. Then go the small claims route.
That is what I’m doing with Equifax, for un/freeze fees, monitoring fees, as well as real-life billable hours for dealing with breech and any punitive damages judge will award for me and DW.
